List of executive actions Obama plans to take as part of anti-gun violence plan
The White House provided the following list of executive actions President Obama plans to take to address what the administration calls “gun violence.” It’s unclear which of the directives directly addresses the Sandy Hook Elementary School shootings, which the president used as the rationale for issuing the actions.
- Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
- Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
- Improve incentives for states to share information with the background check system.
- Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
- Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
- Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
- Launch a national safe and responsible gun ownership campaign.
- Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
- Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
- Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
- Nominate an ATF director.
- Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
- Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
- Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
- Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.
- Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
- Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
- Provide incentives for schools to hire school resource officers.
- Develop model emergency response plans for schools, houses of worship and institutions of higher education.
- Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
- Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
- Commit to finalizing mental health parity regulations.
- Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.
Statement from NSSF in Response to Biden Commission Recommendations
All Americans share the goal of wanting to make our communities and children safer by reducing violence in our society, like the tragic incident that occurred last month in our community of Newtown, Conn. We are reviewing Vice President Biden’s recommendations with an open mind in hopes they will offer real means of achieving our shared goal.
The central issue involved in violence where a firearm is misused is the unauthorized access to the firearm. We believe it is critical to first focus on the unauthorized access to firearms by irresponsible persons and those not legally qualified to possess them.
We support immediate improvements to the National Instant Criminal Background Check System (NICS) that will bring all appropriate mental health and other records, such as restraining orders, into the NICS system. Fixing NICS must be among the highest priorities in order to help further prevent illegal purchases of firearms from federally licensed retailers.
In order to help prevent unauthorized access to firearms in the home, we have long supported and are initiating an expanded safety campaign to promote the secure and responsible storage of all firearms and ammunition when not in use. We believe the personal responsibility of gun owners, especially if there are children or at-risk individuals in the home, is central to any meaningful discussion of the issues.
The NSSF will continue to lend its expertise to this important national conversation and the accompanying legislative and policy making processes. We do so respecting the various points of views represented in these discussions.
Barbour: Gun Industry is Under Attack
At the SHOT Show’s annual State of the Industry Dinner on Tuesday, former Mississippi Governor and Republican Party head Hayley Barbour told attendees, “Make no mistake about it, you aren’t under siege…. you are under attack,” the Outdoor Wire reports.
A very plain spoken Barbour told industry leaders the shooting industry isn’t in danger because it wants the government to do something for it, but “because of what the industry can do to you.”
And the industry and lawful gun owners are likely to once again bear the brunt of restrictions by a lawmakers across the country who seem determined to do something.
“There aren’t two sides in this issue,” said the NSSF’s Steve Sanetti, “I don’t think any one who knows what we do believe we are against such incomprehensible evil.”
Sanetti then went on to speak some truths he says the firearms industry knows but the media refuses to report.
“This industry pioneered the instant background check system,” Sanetti said, ” years before it was a government mandate.”
“Facts,” Sanetti said, “must guide our actions, not emotions, despite the fact we also feel in our hearts the cost of unspeakable evil.”
“We have been deluged with requests for information,” Sanetti said, “but we all know the key is personal responsibility. And we are among the most responsible people in America.
“Violent criminals who violate the law don’t have the right to lawful ownership of arms,” Sanetti said, “they belong in jail.”
NRA Statement on NY Gun Ban
The National Rifle Association issued a statement in response to the newly-signed New York law banning assault weapons and requiring background checks:
“The National Rifle Association and our New York members are outraged at the draconian gun control bill that was rushed through the process late Monday evening.
“Governor Andrew Cuomo and the New York State Legislature orchestrated a secretive end-run around the legislative and democratic process and passed sweeping anti-gun measures with no committee hearings and no public input.
“Hammered out in a backroom in Albany, S. 2230 was quickly drafted and released 20 minutes prior to the Senate vote. It passed as the clock ticked toward midnight.
“This legislation lowers New York’s arbitrary magazine capacity limit from ten rounds to seven. It also greatly expands the state’s existing ban on commonly owned semi-automatic firearms, and will require New York gun owners to undergo background checks on ammunition purchases.
“These gun control schemes have failed in the past and will have no impact on public safety and crime. Sadly, the New York Legislature gave no consideration to that reality. While lawmakers could have taken a step toward strengthening mental health reporting and focusing on criminals, they opted for trampling the rights of law-abiding gun owners in New York, and they did it under a veil of secrecy in the dark of night.
“The legislature caved to the political demands of a Governor and helped fuel his personal political aspirations. New York lawmakers have ignored and excluded gun owners throughout this legislative process, but the NRA and our New York members remain committed to having a meaningful conversation about protecting our children and will speak frankly about the lawmakers who have failed to do so.”
Ruger Distributes ‘Protect Your Rights’ Alert and Link
Ruger urges gun owners to “Contact Your Legislators Now!” by clicking on a link that leads to a company-prepared Take Action Now! page, which allows gun owners to send a prepared email letter to lawmakers quickly and easily.
The Ruger alert says:

More: Many elected officials have been looking for an opportunity to curtail our gun rights and think they can win now if they move quickly while emotions are high. I still say that the idea that I had heard many moons ago would be good if you could get the gun manufacturers behind it. Just enact a policy industry wide to only sell firearms and such to areas where a civilian may own it. Just wait until the police department of the area can barely get their hands on a chief special. The problem with this plan is that it would require all gun companies to get on board, and there would almost certainly be at least one that would be greedy and short sighted.

The sad ting is that this pres has 4 more years to take away our rights. He did a bunch in the first 4 and now does not have to hold back as he can’t run again. (unless he does a exec order changing that also!!)

The only points I don’t particularly agree with outright are 13 and 14. 13 is far too vague and as for 14 I don’t see what the C.D.C. has to do with gun violence. Don’t they deal with pathogens?
Also, (and I note this due to the amount of hype I heard before the statement)I see nothing on this list about Assault weapons, forced registration for gun owners or magazine capacity limits listed. Am I just not catching something or was all that hype for nothing?

Murder Is already banned, as are illegal drugs. It hasn’t stopped any murderers or druggies! America is becoming the new NAZI nation. It’s time to ban politicians. They can keep their change. I want the old safe America I loved as a child where everyone owned guns, left the doors unlocked and didn’t have to worry about being robbed because the thieves knew buckshot would greet them upon arrival! We are a politically correct, government dependent, non-working bunch of cowards. If they care so much about our kids they need to stop promoting abortion and funding terrorism, and apologizing to murderers, were being blindfolded for genocide and too dumb to stand up against it.

Wow~ where is the “Presidential Directiveness”? I thought these were called “Executive Orders”. All I see here is a bunch of Political Rhetoric, very hollow in meaning, with open ends everywhere. Most of them sound like; “Look into this, and look into that…” Let me address them one at a time. As a cop, I know that most of these hollow statements are already being done. What these 23 actions really do is to open the door for later, middle of the night, sanctions, or new rules after the reports come back to him with clearer definitions; most having to do with the mentally ill.

Really? Don’t they already do this? What is included in the current background
checks?

What he’s really saying is, “Lets close the loopholes on HIPAA so that we can
force the states give up information that they don’t want to give up”.

Common Barry! Improve incentives? So you already pay the states! What are you
going to do now, pay them more; When our government is already out of money? So
you want the states to be more of a “taker” than they already are?

Review? Really? This is about as “open ended” as it gets. Wait till the review
gets back, then the real new definitions will be made into law, overnight, when
nobody is watching.

As a cop, this one really scares me. Do you know how many guns are “illegally
seized, then later ordered returned by the court? But if this proposal goes
through, the victim of the illegal seizure has to go through a full background
check, using the new definitions that will be put into place after all these
“reviews” get back. What I see is the court saying “give him his gun back, then
L.E. saying sorry dude, you don’t pass the new background check. Meltdown
time….
“6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.”
Publish an instructional letter… This is a real “executive order”….
Launch a national safe and responsible gun ownership campaign.

Ok, so now you’re going to make the feds (FBI) do what is already being done at

He did this right after signing these 23 actions. This is no executive order; it
is a normal part of Barry’s job; which, BTW, he hasn’t done in years…

Already in progress; been through this training myself.
“12. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.”
This statement is about as hollow as they come, since L.E. already does this.
Wait a minute… does this mean…. I mean…. is Barry gonna put more cops on
the street? Maybe this one will get my support.
OK, so I’m getting tire of my “rant”. Do you get the picture though, of how hollow these Directives really are? Do you see how they leave themselves wide open for further defining and legislating at a later point in time? That’s the part that scares the heck out of me.
I’ll leave the rest of the 23 Executive Orders for you to read and interpret.
But before you go, check out #21 “Commit to finalizing…” Doesn’t that sound like a New Year’s Resolution? And this is supposed to be an Executive Order? Makes me want to laugh, or cry… and he is our POTUS….

I would like for the sporting goods industry to quit using the rhetoric of the gun grabbers. Any gun that does not sport or have provisions for a bayonet, or is not fully automatic is NOT an assult weapon. It is merely a sporting rifle, regardless of configuration or color.

Concerning #16 of the Executive Actions listed above about the Affordable Care Act not prohibiting doctors from asking patients about guns in their homes, the amendment may not “prohibit” a doctor from asking but under (c) Protection Of Second Amendment Gun Rights in paragraph (5) Limitation On Data Collection Requirements For Individuals
- No individual shall be required to disclose any information under any data collection activity authorized under the Patient Protection and Affordable Care Act or an amendment made by that act relating to-
(A) the lawful ownership or possession of a firearm or ammunition; or
(B) the lawful use, possession, or storage of a firearm or ammunition.
As I see it the Executive Action CONTENDS that a doctor can ask a question about guns but the amendment to the Affordable Care Act clearly states that we don’t have to “disclose any information” or ANSWER any of these questions. So if a doctor asks these questions answer by stating that “The Law doesn’t require me to answer”

I am 68 yrs. old; ex-police officer. I have a C.W. permit. It is NOT guns, it is the person. Look back a few years this did not happen. They took God from the schools and the courtrooms. And most children don’t know the Ten Commandments. They do not hear them. That Thou shalt Not Kill. Their parents don’t tell them this and don’t take them to CHURCH on Sundays. They go shopping, fishing, ball games, etc. Let them play killing games and watch KILLING MOVIES. So.They believe it is ok to kill, to get even. Life is nothing to them. These people grow up not knowing any better. So SAD.

Can’t wait for charging up to triple for ARs and AKs to stop. People need to quit paying those BS prices. The Senate nor Congress has the votes to pass an “Assault Weapons” ban. Banning High Cap Mags on the other hand may pass. Doesn’t really make any sense but most of these people know nothing about firearms, our culture, or traditions. Be patient. Don’t pay $2200 for an Sig M400, that’s ludicrous. It will go back to a grand or less shortly…

Lawmakers are missing the point completely, especially in New York. They are focusing their attention on an inanimate object (firearm) that has no power to act on its own instead of the person or persons controlling that inanimate object (firearm). Enforcement of the current laws, bolstering the NICS background checks, and sharing information regarding mental instability and family violence will do more than eliminating and/or reducing firearm configurations or magazine capacities.

YES!! Let us all remember that a vast majority of mass shootings are committed by people with mental health issues, not by law abiding citizens who observe gun ownership safety and regulations. If government officials NEED to do something in the wake of the latest devastating shooting in Connecticut…. Let’s all pray it is to focus on the real problems among which are, getting help to the mentally ill, with or without their consent and serious consequences for having a gun unlawfully. Not by infringing further upon our rights as Americans provided by the 2nd amendment!! God Bless America!!

1st 3.5 years in office the weekly average of EOs is 5. Is it necessary to use a month’s worth of EOs to reiterate laws that already exist? The 1 sentence summaries might sound logical but we need to dig into the hidden details of each EO. For instance:

No one ever said this world would be a perfect place, the tragedy at Sandy Hook elementary school is absolute evidence of this. We as a rational people want an answer as to why this and other tragedies have happened. We want a simple and clean solution that can be quickly put in place so we can rest easy, to be able to say it will never happen again. The sad reality is: Regardless of what we do, it will happen again. It will happen many times and in many places, and the “body counts” will grow ever larger. This is not new; people have been killing each other for stupid reasons over many millennia. It seems that the “Evolution” of mankind is a little slow in this department.
It is a very sad and disturbing situation to see innocent children become victims, for families to be torn apart, loved ones lost. There are those who are banging the drum for ever tighter gun laws and bans as though this is the one and only solution and will end violence forever. Truth be known, this will never solve the problem; as long as there are people in this world there will be violence, and the innocent will always pay the price.
As a nation we have long turned our backs on the mentally ill, we want to sweep it under the carpet as though it doesn’t exist. Why? Has no one noticed that these crimes are committed by those who are mentally unstable, mentally ill? The criminally ill care nothing for laws of any kind; they are not deterred by life prison sentences, death row, or any other punishment you can come up with. This is obvious by the fact that most commit suicide at the end of their crime. We need to pay much more attention to this problem, to offer help to those who need it, and do it without the stigma that we now associate with mental illness.
Columbine, Tucson, Aurora, Sandy Hook, there are many more but they all share a common connection, the perpetrators all had mental problems. Why were these people allowed or forced to live their lives in the darkness of the mentally ill? We see people all around us who obviously do not have it all together upstairs, and we avoid them like the plague! Which one will become the next Super Villain, which one will be the next to kill innocent bystanders? How will we know, and how will we prevent them from obtaining any kind of weapon, let alone guns?
No, guns are not the real problem; they are just a tool, an inanimate tool, a tool which in the right hands can save lives; but in the wrong hands will just create destruction. Politicizing this issue is an injustice to those who have lost their lives, have been wounded, or have had to witness these deeds. These are deeply life altering occurrences that affect victims, family, friends, first responders, and society as a whole. The victims deserve better than a political dog fight over gun rights and laws that ultimately will have no teeth.
We as gun owners must also take up the responsibility of storing our firearms securely and safely so unauthorized people cannot gain access to them. We must also educate the public about gun safety; too many people in society are “Gun-Illiterate”. We also need to take a hard look at this culture of violence that is spewed at us on a daily basis on TV and in the movies; it is clearly showing its ugly head in our society.
I urge you to contemplate what I have written, to seriously consider starting a dialog on gun safety, mental illness, and violent content in the media. We must, as a nation, begin to deal with the real and deadly issues that we now face; simply banning rifles and magazines is a poorly thought out and ineffective solution.

#16 is in direct violation of the ACA, Obamacare. Google “hidden gun rights language in obamacare” Drs CANNOT be compelled to ask if firearms are in a persons home, and patients CANNOT be comelled to answer. Even if a Dr does ask and a patient does tell, Drs and hospitals are specifically forbidden from recording this info and mainaining a database with this information. That’s right Obama, the bill was passed and now we are finding out whats in it. And guess who allowed that language to be added, Harry Reid. Hey Obama, eat cake.

I see no sincerity, they could care less about my children. I believe this is something much more base. These folks are like young children, they don’t like to be told ‘no’ on anything – emotional immaturity. An armed citizenry can say ‘no.’

This administration could use the help of an organization dedicated to training, safety, and legal use of firearms. Now where could they find such a group??? Hmmmmm. But, if they did that, how could they villify and divide the country? And, don’t tell your doctors anything! They’ll try to label every gun owner as a nut, and seize your rights.

Just heard from an insider, Walmart is suspending sale of rifle ammo. Let them know, that if they cave to this kind of media pressure, they may as well get rid of all sporting goods. No point in shopping at a store that does not serve you.

Let’s be clear…we are in the fight of our lives to protect and uphold the Constitution, our 2nd Amendment Rights and our future freedom from the tyranny of a potentially oppressive government if any more gun controls are implemented! (You think they won’t take away more of our rights if they can get some taken away now?!)
That is why you must fight back now! Let your Congressman and Senators know everyday…yes everyday…that you want them to vote NO to any gun controls. Let them know in no uncertain terms what your want and that you will be watching their voting records for use come election time.

Every time I go in there, the ammo shelf is getting emptier and emptier. I was there a couple days ago, and I wondered to myself: “…it looks like they aren’t even ordering more ammo…”

I still don’t see the primary cause of almost all of the gun violence in our country being mentioned by politicians or all of these comments. That primary cause is the fact that most, if not all, of these shooters/criminals have either been placed on very strong psychological drugs, and/or quit taking such drugs, without medical advice to quit, just prior to their evil deeds. We have shrinks all over the country over prescribing many very strong drugs, seemingly without considering the severe adverse reactions they know many of their patients will experience. Just look at all the ads on TV for such drugs, which always include warnings about the side effects, including having “homicidal or suicidal” thoughts or feelings. We allow these snake oil salespeople quacks (i.e. psychiatrists) to overload so many young people with all of these different drugs and then wonder why such mayhem results. STOP THE PSYCHO DRUGS AND MUCH OF THE PROBLEM WILL BE RESOLVED. (by the way, that’s also why the CDC and other health agencies are being involved by Obama’s plans).

As someone who recently had a firearm stolen, I can attest to the lack of attention it received from law enforcement. Before anyone complains, I do have a gun safe however, it was a present for my nephew and I was home for Christmas. My family simply puts their shotguns over the mantle and I never expected someone to take a Crickett. Anyway, called the City Police and spoke to dispatch. Even told them who was suspected of taking the gun as it was a local kid who is a junkie and was seen lurking about that day, but never heard back from them. I called the County Sheriff’s Office with the same info. They did take a report, but never heard back from them. After a couple of days without them returning my call, I decided it would be good to get my gun back myself. I informed the kid I believed stole the gun that I had several more and unless he wanted to see them in action up close, the gun should be returned. I got it back the next morning although the young man said he didn’t take it, but was able to find it. In the end I found local LE care little about a stolen gun and it is stil my responsibility to take care of myself and my family.

So taking the guns out of our hands it will leave us at the mercy of the law officers.So while the person that just killed your family just walks away and all you can do is watch and the police would just get information about what happen and never catch the person.If the government comes to there senses than we can not let our families be harmed in any way.
